Ask Us, and We Answer With Our Experience: They promised to build my invention…

Question: “They promised to build my invention—but delivered a disaster instead”

In one of our recent successful cases, a client came to us after investing in what was meant to be the launch of a unique tech innovation. He had signed an agreement with a company that claimed to specialize in web and app design and development. The company assured him it had the necessary expertise to manage and execute complex digital projects.

Our client’s idea was creative and practical: a touch-based keyboard device that connects to smart devices via Bluetooth. It was designed to allow the user to control certain functions—like weight measurement—by displaying virtual visuals on the connected smart device. The design also included a stand to support both the device and the smartphone at neck level, with the keyboard fitting comfortably in the user’s hand.

The Agreement & Breach

Both parties agreed that the company would develop the product and bring the project to life within six months of signing the contract and receiving payment from our client.

The agreement also included a commitment to:

  • Internationally register the invention’s patent upon completion
  • Securely store all confidential data related to the project
  • Limit access to that data strictly to authorized parties

Our client fully honored his part of the deal, paying all agreed amounts. However, the company failed dramatically in its delivery. The device produced was of poor quality, lacked functionality, and did not meet the agreed specifications in any way. In short, it was nothing like the innovative product envisioned—and promised.

The Legal Action

We filed a lawsuit before the Intellectual Property Court, requesting:

  • Termination of the contract
  • Financial compensation for breach of agreement

The court appointed a panel of three experts—two technical and one financial—to evaluate the situation. Their findings were clear: the company did not fulfill the contract terms and had failed to deliver on both quality and functionality.

Outcome

The court ruled in favor of our client, ordering:

  • Termination of the contract
  • Compensation of 1 million AED to our client for the losses and damages incurred

Our Insight

This case is a powerful reminder: always ensure that contractual promises are backed by legal accountability, especially in innovative or tech-driven ventures. When things go wrong, the right legal strategy can not only protect your rights—but secure the compensation you deserve.
