A landmark victory: securing 500,000 AED in compensation and rights in an employment dispute

Client Overview

On 16th November 2023, the actual employment relationship between the parties began based on the job offer sent by the opponent to our client via WhatsApp message on 17th October 2023.

The claimant (our client) was previously employed in the Kingdom of Saudi Arabia, and the defendant sent him a job offer via WhatsApp to join their team in the UAE.

The claimant accepted the offer, and the working relationship was established through the exchanged messages between the claimant and the employee at the defendant’s company.

Accordingly, we took the necessary steps to claim our client’s labor rights.

Challenges

Prove the working relationship

Based on the consultants’ experience, we were able to, through all possible and even unconventional means, which required extraordinary effort, prove the working relationship.

Our client visited our office seeking assistance in claiming his labour entitlements from the defendant company, amounting to AED 523,600, along with a return ticket worth AED 3,000, and the fees, expenses, attorney’s fees, and 5% interest from the date of the claim, and an experience certificate.

We filed a lawsuit, registered in court on 5th July 2024.

Solution

We have presented all the defenses that ensure our client’s rights, resulting in a verdict being issued in his favor.

The court ordered the defendant to pay the plaintiff an amount of AED 425,600, along with legal interest at a rate of 5% from the date of the legal claim until full payment.

Additionally, the court ordered the defendant to provide a return ticket to the plaintiff or its monetary equivalent, unless the plaintiff had joined another employer.

The court also ordered the defendant to issue a certificate of end of service for the plaintiff, stating his date of employment, date of termination, total duration of service, job title or type of work performed, last salary received, and reason for termination of the employment contract.

The court required that the certificate should not contain any statements that may harm the worker’s reputation or reduce future job opportunities.
